What a dummy! Open carry is legal in PA but it's sure not smart. Ranks right up there with showing up at a Toby Keith concert in a Dixie Chicks t-shirt.

I'm with the judge on this one, she certainly does not show good judgment showing up at a soccer game with a gun on her hip.

So you're saying the 2nd amendement only applies when everyone else approves?

If that's the case, in about two months we're ALL gonna be hosed.......

What she did was NOT against any law.....maybe not the BEST idea, but not illegal.
Where does the Sherriff come off pulling her permit?

There are many folks in Virginia who have successfully won judgements against uninformed LEOs/departments who have harrassed/arrested/detained them for legal open carry.

Either we have the right, or we don't........which is it?

That ain't what I'm saying and you know it. The sheriff should not have pulled her permit and I never said that he should have. I said I agreed with the judge that she showed poor judgment by open carrying at her kid's soccer game - the same judge who reinstated her carry permit. The sheriff was clearly wrong here.

Just because you have the right to do something does not make it a good idea. If you are in a gun-phobic atmosphere, it is unrealistic to expect that you will not be hassled if you have a gun on your hip. This discussion is not so much about what you have the right to do, but what is the smart thing to do. See my analogy in my first post - you can wear the Dixie Chicks t-shirt but you'd be smart to put a jacket over it.

My point is that even in gun-phobic Northern Virginia, and even in local $tarbuck$, folks ARE open carrying.
Sure they are getting a few shrieking soccer-moms, and panty-waisted Yuppies calling the cops with "Man With A GUN!" reports, but they're also educating the Cops and the masses that our 2nd amendment rights are also important.
The 9-1-1 operators are also getting "schooled" about asking the caller if the MWAG is acting strangly, or waving the gun around, or just shopping.
When the caller admits the MWAG is just shopping, the operator educates them on the Open-Carry laws of the State of Virginia.

The cop's job is still supposed to be to enforce the existing law...

As for the Dixie Chicks shirt at a Toby Keith concert thing.......If you got the guts to do it, it's still not a crime....If you're assaulted while wearing it, who's going to spend the night in jail?

Sounds like a 1st amendment protected thing to me.

Argh! We are talking past each other here, Ed. I'm not disagreeing that we have a right. What I'm saying is that I think it's foolish to exercise that right in such a way that one draws negative attention to oneself.

Dave, I'm saying that if we can't legally excersize a right if someone is going to disagree.....is it really a right?

Her actions were legal and the judge ultimately upheld her 2nd amendment right - so yes, it really is a right.

When you get right down to it, the Constitution only affirms our God-given rights. What the courts say about our rights should be immaterial.
